Terms of Service

These Terms of Service ("Terms") govern your use of Formiq ("Service"), operated by Opportunity Inc. ("we", "us", or "our"). By using the Service, you agree to these Terms.

- "Service" means the web application at formiq.app and all related features. - "User" or "you" means any individual who uses the Service. - "Paid Plan" means either the monthly plan (6,000 JPY/month) or annual plan (48,000 JPY/year). - "Content" means chart settings, trade records, backtest results, and other data you create or store on the Service.

The Service is a charting and analysis tool for foreign exchange (FX) markets. It is not investment advice. Specifically: - We are not a registered investment adviser, broker, or dealer. - Nothing on the Service constitutes a recommendation to buy, sell, or hold any financial instrument. - All information provided — including chart data, indicator calculations, backtest results, and AI assistant responses — is for informational purposes only. - The Service uses external AI services (large language models) for its AI assistant feature. AI responses are auto-generated and may be inaccurate. They do not constitute investment advice.

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 or older. If you are under 18, you may not use the Service.

You may sign in using an email address and password or a Google account. You are responsible for keeping your account secure and must not share access with others. We are not liable for unauthorized use of your account.

- Basic features are free. - Paid Plan payments are processed by a third-party payment service. We do not store your credit card information. - Subscriptions renew automatically at the end of each billing period. - You may cancel at any time. Access continues until the end of the current billing period. - Fees already paid are non-refundable except as required by law. - We may change fees with 30 days' prior notice.

The Service relies on third-party services to operate, including: - Authentication and database services - Payment processing services - AI services - Market data providers Each third-party service is governed by its own terms and privacy policy. We are not responsible for outages, changes, or discontinuation of any third-party service.

You must not: - Violate any applicable law or regulation - Overload or interfere with the Service's servers or network - Reverse-engineer, decompile, or disassemble any part of the Service - Attempt unauthorized access - Use the Service to operate automated trading bots - Collect other users' information without consent - Redistribute information from the Service as investment advice - Infringe on the rights of any third party

The Service is an analysis tool, not an investment advisory service. Use of the Service does not create an advisory relationship between you and us. All investment decisions are your sole responsibility. We are not liable for any trading losses arising from your use of the Service, including but not limited to losses based on chart analysis, backtests, or AI responses. Past backtest results, indicator calculations, and AI-generated analysis reflect historical data only. They do not guarantee or imply future performance. FX trading carries a risk of loss that may exceed your initial investment. You should fully understand these risks before trading.

Exchange rates and historical data come from external providers. We do not guarantee their accuracy, completeness, or timeliness. Indicator calculations follow publicly known algorithms but may differ from other tools due to methodology or data gaps. We are not liable for any loss caused by data delays, errors, gaps, or calculation differences.

All intellectual property rights in the Service belong to us. Content you create remains yours, but you grant us a non-exclusive license to use it as needed to operate and improve the Service.

We may change or temporarily suspend the Service without prior notice. We may discontinue the Service with 30 days' notice. Third-party service changes may limit or disable parts of the Service. We are not liable for any loss caused by changes, suspension, or termination of the Service.

We may suspend or delete your account without notice if you violate these Terms. Your data will be deleted within a reasonable period after account deletion.

The Service is provided "AS IS" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or availability. To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, special, consequential, or punitive damages, or lost profits, arising from your use of or inability to use the Service. If we are found liable, our total liability is limited to the fees you paid us in the 12 months before the claim arose. These limitations apply to the fullest extent permitted by applicable law.

We may update these Terms as needed. Updated Terms take effect when posted on the Service. We will notify you of material changes by email or in-app notification. Continued use after changes constitutes acceptance.

These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court.
